Product Return Policy

PRODUCT RETURN POLICY:

Hogue Surgical Returns is the entity that processes all product returns for Hogue Surgical, LLC. They are one and the same company. Hogue Surgical Returns can revise its PRODUCT RETURN POLICY ("Policy") at any time by updating this posting, and your continued use of our e-commerce website after such change signifies your acceptance of the changed terms. Please check our PRODUCT RETURN POLICY periodically for changes.

Decontamination Certificate

Hogue Surgical requires the submission of a valid and signed Decontamination Certificate for all returned products to our premises, in compliance with US transportation laws, and to protect our staff from unknown contamination. All products contaminated by blood, body fluids, or any other potentially infectious or bio-hazardous materials must be properly decontaminated as indicated in the "Directions for Use" accompanying the product. PRODUCTS WILL NOT BE ACCEPTED WITHOUT A COMPLETED DECONTAMINATION CERTIFICATE. An accompanying RMA number must also be affixed on the exterior of the shipping container where it can be clearly viewed upon acceptance of the return.

There are three types of PRODUCT RETURNS allowed by Hogue Surgical Returns:

1. PRODUCT RETURN - COVERED UNDER WARRANTY:

Hogue Surgical guarantees to the original purchaser of its products a 30-day warranty against manufacturer defects in material and workmanship. If the warranty claim is approved by Hogue Surgical Returns, at its sole discretion, the returned product will be repaired or replaced free of charge then returned to the customer by UPS Ground at the customer's expense. The customer's credit card will be charged for shipping & handling charges. The shipping & handling charges will be reflected on the invoice. No refunds will be given for an approved Covered Under Warranty claim. Covered Under Warranty repairs do not extend the original warranty period of '30 days from the original invoice date'. If the warranty claim is denied by Hogue Surgical Returns, at its sole discretion, the product will be processed as a Product Return Not Covered Under Warranty. The customer is responsible for payment of all shipping & handling charges related to a product return to and from Hogue Surgical Returns, irrespective of the final warranty status determination (Covered Under Warranty or Not Covered Under Warranty). Hogue Surgical Returns does not refund or pay for any shipping charges. Please submit your RMA Request on our RMA Portal System at http://hoguesurgical.returnsportal.net.

2. PRODUCT RETURN - NOT COVERED UNDER WARRANTY:

Hogue Surgical will allow the original purchaser of its products, at its sole discretion, to return purchased products for repair without a warranty claim. The returned product will be inspected and repaired at the customer's expense then returned to the customer by UPS Ground at the customer's expense. Upon approval, the customer's credit card will be charged for repair costs and for shipping & handling charges. The shipping & handling charges will be reflected on the invoice. Not Covered Under Warranty repairs do not extend the original warranty period of '30 days from the original invoice date'. The customer is responsible for payment of all shipping & handling charges related to a product return to and from Hogue Surgical Returns, irrespective of the final warranty status determination (Covered Under Warranty or Not Covered Under Warranty). Hogue Surgical Returns does not refund or pay for any shipping charges. All returns must be submitted by an RMA Request on our RMA Portal System at http://hoguesurgical.returnsportal.net.

3. PRODUCT AUDITION RETURN FOR A REFUND:

Hogue Surgical Returns will allow the original purchaser of a Product Audition product return, at its sole discretion, to return the auditioned product for a refund under certain conditions. The returned product must have been assigned a Product Audition status on the original invoice. The Product Audition product return must be returned securely packaged in its original packaging and shipped to Hogue Surgical Returns within 30 days of the original invoice date in order to be eligible for a refund. After inspection of the returned auditioned product to Hogue Surgical Returns, the customer's credit card will be credited back the original purchase amount. The customer is responsible for payment of all shipping & handling charges related to the shipment of a product purchased under a Product Audition status. Hogue Surgical Returns does not refund or pay for any shipping & handling charges. Please submit your RMA Request on our RMA Portal System at http://hoguesurgical.returnsportal.net.

WARRANTY LIMITATION

Except as described in this Policy, Hogue Surgical makes no other warranty, express or implied, with respect to its products, nor with respect to its specifications, except as expressly stated herein. HOGUE SURGICAL MAKES NO WARRANTY OF MERCHANTABILITY WITH RESPECT TO ITS PRODUCTS, AND FURTHER MAKES NO WARRANTY THAT THE PRODUCTS OF ITS MANUFACTURE ARE FIT FOR ANY PARTICULAR PURPOSE.

Defects in products caused by misuse, mishandling, improper storage, or any other failure to strictly follow Hogue Surgical's documentation and procedures are not warranted under any circumstances. Hogue Surgical shall not be responsible for incidental or consequential damages as such terms are defined in Section 2-715 of the Uniform Commercial Code, or any other applicable or successor law defining said terms, regardless of cause. Hogue Surgical's sole responsibility and liability under this warranty shall be as described in this Policy under the stated warranty period. This is the sole remedy under this warranty. This limited warranty may not be transferred or assigned.
